The following terms and conditions apply to all orders placed by the customer (hereafter referred to as "you") to the Visus Cultural Association (RO13864920, hereafter referred to as "Legendárium", "our" or "us", on the www.legendarium.ro website), on the mobile version of the site.
By using www.legendarium.ro and / or placing an order, you agree to abide by the terms and conditions specified below ("Terms"). Before placing an order, please make sure that you have read and understood the Terms.
Only persons with a minimum age of 18, who are not under guardianship, do not work as legal entities and who have their domicile, residence or other address in Romania (excluding address forwarding companies) can place an order.
Including any products or services on www.legendarium.ro at a certain time does not imply or guarantee the immediate availability of these products or services. We reserve the right to conclude the marketing of a product at any time.
We reserve the right to change these Terms from time to time without prior notification. Your orders will be subject to the Terms specified on www.legendarium.ro at the time of placing the order.
The Legendárium team wants to offer the best online experience. For this, we need to make sure that our services work flawlessly. Understand and agree that you ought not to post, redistribute, upload, or promote any communications or content that could harm or adversely affect our company, products, or services; do not act in this way or use any device that would restrict, impede, incommode or prevent any other user from using or benefiting from the www.legendarium.ro site or that would affect the security of the site.
Do not use any device or attempt to use any engine, software, tool, agent, script, or other device or mechanism (which includes but does not limit spiders, bots, indexing robots, avatars, or intelligent agents) to navigate, search the site or to copy content from the site. We reserve the right to immediately block access to the site and to close the account of any user who violates this or any other provision specified in these terms and conditions.
The prices displayed on www.legendarium.ro include the value and taxing additions provided by the law, but do not include a delivery fee.
Delivery method
The delivery of our orders is made exclusively on Romanian territory through the fast courier company Fan Courier. In order to ensure the integrity of the package, we ask you to carefully check the documents that accompany it upon receiving it.
Method of payment
Payment is made by cash on delivery to the representative of the express courier company, when you receive the package.
Shipping costs
Delivery costs of our products are set based on the average prices determined by sc. FAN Courier srl and the Romanian Post.
Delivery time
Immediately after completing the order, you will receive a confirmation email. Delivery time is a maximum of 3 working days from the moment of confirming your order.
Ordering options are available on the website www.legendarium.ro.
Immediately after placing your order, if you have provided us with your email address, you will receive a confirmation email. If, for any reason, we are unable to process your order, we will notify you as soon as possible. If we have already received payment for your order, we will attempt to refund that amount using the same method as the one used to make the payment. If, for some reason, other arrangements are required, we will notify you and ask you to contact Legendárium Customer Service, which will reimburse you.
The Legendárium team makes every effort to accept and process orders, and will attempt to deliver your order to a home address or another address in Romania or to another country mentioned in the order, depending on the delivery option you select.
The Legendárium team will try to make every effort to ship orders as soon as possible and in the succession in which they were placed. Our desire is to deliver the order within 1 to 14 working days from its confirmation. Although we make every effort to succeed in shipping the orders within the aforementioned interval, we inform you that it may take longer due to possible unforeseen events, which are beyond our control; however, it should not take more than 30 calendar days from the date of order confirmation. If the delivery time exceeds 30 days, you can cancel the order.

If you wish to cancel or return the order, please send us a written notification either by letter of acknowledgment of receipt or by e-mail. We will try to make the refund using the same method used to make the payment (or, if the items have not been paid yet, we will reflect the return of the items in your account balance) as soon as possible, no later than 14 days from receipt of your notice of cancellation, provided we have received the items or proof that you have returned them. Another method of payment for refund may be used, provided you agree to this modification; this will not incur additional costs.
If the item you received is defective, please notify Legendárium immediately and return the item in accordance with section 6 (Returns) below. For any products considered defective, Legendárium will make a full refund. The provisions specified here do not limit any applicable rights dispensed by law.
Products purchased from our online store can be returned according to O.G. 34/2014, within 14 working days from receiving them. The return of the products must be announced in advance by email to adresainfo@legendarium.ro, using the withdrawal form to fill out provided in Anexa 1, or any unequivocal statement in which you express your decision to withdraw from the contract. Returned products, including packaging, must not be damaged or show signs of usage and they ought to be accompanied by the invoice with which they were shipped.
The shipment of the replaced products will be made within 3 working days from the receipt of the initial ones, and the shipping costs will be borne by the customer. If the customer wants a refund of the value of the products, the Visus Cultural Association will return the value of the products within 3 working days from receipt. For this, we ask you to specify: your name, IBAN number and the bank where the account is opened. The amount refunded will not include transport costs.
If the products are returned due to a non-conformity found by the customer upon receipt of the products (colored item / size different from those ordered, quality problems) all transport costs will be borne by the Visus Cultural Association.
7. Payment Methods
Credit or debit card (coming soon)
You can enter your payment details when placing your order using a valid credit or debit card (VISA or Mastercard). The amount will be immediately blocked on your card, but will not be debited until the goods are shipped. Legendárium reserves the right to verify the validity of a credit or debit card, credit-worthiness in relation to the value of the order and whether the buyer's address is correct. Depending on the result of these checks, we may decline certain orders.
Cash on delivery
You can choose to pay in cash on delivery upon receipt of the goods, at no additional cost.
8. Our responsibility
Nothing in these Terms shall exclude or limit Legendárium's liability in respect of any matter for which it would be unlawful to limit or exclude our liability.
Legendárium takes responsibility for death or personal injury caused by our negligence or that of our employees or representatives. We do not intend to exclude accountability for false statements made by us or our employees or representatives.
In the event of a breach of these Terms, we will only take responsibility for losses that are a reasonably foreseeable consequence of such breach.
Legendárium does not take responsibility for indirect losses that are a side effect of the principal loss or damage, such as loss of profits or loss of opportunity, or for failure to deliver the goods or to fail to perform any of our obligations under these Terms if this impossibility is caused by an event over which we have no control, which includes but is not limited to: fire, flood, storm, uprising, civil unrest, war, nuclear accident and terrorist activity, major forces.
Our maximum accountability to you regarding any loss or damage that occurs in connection with your order on www.legendarium.ro will be limited to the total price of your order.
If you have a problem with a product that you purchased from Legendárium online and were unable to resolve your complaint with Legendárium, then you can file a complaint on the EU online dispute resolution platform (the "SOL platform").
The SOL platform offers EU consumers and traders the opportunity to try to obtain an alternative solution to complaints related to online purchases. This single point of contact is designed as an interactive and easy-to-use website, available in all official EU languages and free of charge. By using the SOL platform, the consumer and the trader can find a dispute resolution entity and then go through the procedure of finding a solution to the consumer complaint. The SOL platform is available here: http://ec.europa.eu/odr.
9. Colors and measures
We make every effort to display the characteristics of our products correctly, including their composition and colors. The color you see will depend on your computer system, and we cannot guarantee that your PC will display these colors authentically.
The measurements of an item offered on www.legendarium.ro are only approximate values to help you better understand the pattern or cut of a particular item of clothing. These are not a guarantee of the actual measurements of the item that will be delivered to you. There may be differences of a few centimeters more or less in the final measurements of an article depending on the material used to produce it.
10. Warranty
If the goods you have purchased are defective, Legendárium complies with all regulations provided by law regarding the warranty. If you have a complaint about obvious defects in material or workmanship of the goods we have provided, including damage during transport, please let us know by returning it immediately using the pre-printed return form to be filled in the package.
11. Transfer
Legendárium reserves the right to assign or transfer to third parties a commitment for any claim / payment claims arising in connection with the delivery of the goods.
12. Breaking off a term
If any part of these Terms is prohibited or deemed ineffective by any court or regulatory body, the other Terms will continue to apply.
13. Property rights
All intellectual property rights, such as trademarks and copyrights on www.legendarium.ro, belong to the Visus Cultural Association, its subsidiaries or licensors. Any use of the www.legendarium.ro site or its contents, including the copying or storage of all or part of the content, for any purpose other than for your personal and non-commercial use, is prohibited without the permission of Legendárium.
